I am participating (and/or I am a parent of a minor participating) in yoga classes, health programs, workshops and/or other wellness, bodywork, therapy, exercise, and healing arts activities (collectively, the "Activities") offered by INSPIRE WONDER LLC Yoga by MARANDA RIEK, and any employees, independent contractors, assistants, affiliates, volunteers and business location of the class: — please select a class location above — (hereinafter collectively, "Released Party").
In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily, and expressly waive any "Claim" (as defined below) I may have against the Released Party that I may sustain as a result of participating in the Activities even if the Claim arises from the negligence of Released Party or anyone else. I agree to indemnify and hold harmless Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of Released Party or anyone else.
"Claim" includes but is not limited to any and all liabilities, claims, demands, expenses, fees, related costs, legal actions, rights of actions for damages, personal injury, mental suffering, and distress, or death that I may suffer, my spouse, children, or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activities. The Activities may be offered in the physical location or offered online by videos, television, podcasts, apps, or other digital media or platforms.
I, for myself, my heirs, executors, administrators, assigns or legal representatives knowingly and voluntarily enter into this Waiver and Release of Liability and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activities offered by the Released Party.
I acknowledge that I must be in adequate physical and mental health to participate in the Activities. I understand that the Activities may require intense physical exertion, I represent and warrant that I am physically fit enough to participate, and I have no medical condition which would prevent my full participation in the Activities. I recognize that the Activities may cause or aggravate a physical injury or a medical condition. I understand that it is my responsibility to consult with a physician before my participation in the Activities.
In consideration of being permitted to participate in the Activities, I agree to assume full responsibility for any risks, injuries or damages, property damages, known or unknown, which I might incur as a result of participating in the Activities, including those which may result from the negligence of the Released Party. In the event that any damage to equipment or facilities occurs as a result of my or my family's actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
In the event that I should require medical care or treatment, I authorize the Released Party to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency transport, and sharing medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
I hereby understand that the Released Party from time to time may photograph, video, or otherwise record Activities and place such photographs and videos on its website or social media platforms. I hereby consent to the use of my image that may appear in any such photograph or video.
This agreement shall be construed in accordance with, and governed by, the laws of the State of NORTH CAROLINA and that all actions, suits, claims, and proceedings relating to this agreement shall be brought in a court of competent jurisdiction located in WAKE COUNTY. This Waiver and Release of Liability supersedes any and all previous oral or written promises or other agreements.
I am a voluntary participant in the Activities and I am participating in the Activities entirely at my own risk. I acknowledge that I have carefully read this agreement and fully understand its contents. I am aware that by signing this agreement, I am giving up substantial rights, including my right to sue. I affirm that I am of the age of 18 years or older (or have a parent/guardian signing on my behalf), and that I am freely signing this agreement.
This Waiver and Release of Liability shall remain in effect for the duration of my participation in the Activities, during this initial and all subsequent Activities of participation. I agree with the waiver for today's class and any future class/event.
